1. Agreement to Terms
By downloading, installing, or using applications created by Ondine Digital ("we," "us," or "our"), or by accessing our website, you agree to be bound by these Terms of Use. If you do not agree to these terms, do not install or use our applications or website.
2. License Grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use our applications on devices owned or controlled by you, strictly in accordance with these Terms and the usage rules set forth in Apple's App Store Terms of Service.
3. Intellectual Property Rights
All right, title, and interest in and to our applications and website—including but not limited to source code, user interfaces, design assets, algorithms, branding, logos, graphics, and audio assets—are and will remain the exclusive property of Ondine Digital. You may not decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the applications.
4. User Content
Our creative applications enable you to create original content (e.g., drawings, visual layouts, audio recordings). You retain full ownership and copyright of any content you create using our apps. We do not claim any proprietary rights over your creations, nor do we store them on our systems. You are solely responsible for backing up your work.
5. Disclaimer of Warranties
Our applications and website are provided on an "as is" and "as available" basis, without warranty of any kind, express or implied. We do not warrant that our applications will meet your requirements, be uninterrupted, secure, or error-free, or that defects will be corrected.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Ondine Digital or its developers be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of data, loss of profits, or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort arising in any way out of the use of our applications or website.
7. Governing Law
These Terms of Use and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any legal action or proceeding relating to your access to, or use of, our applications or website shall be instituted in the courts of Australia.
